Terms and Conditions
Webbit Media, LLC
Effective Date: June 24, 2026
Last Updated: June 24, 2026
These Terms and Conditions (“Terms”) govern your access to and use of websites, landing pages, forms, scheduling tools, chat services, communications, products, and services operated or provided by Webbit Media, LLC (“Webbit Media,” “we,” “us,” or “our”), including services offered under the GrowthCommander AI name.
By visiting our website, submitting information, communicating with us, purchasing services, or otherwise using our website or services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use our website or services.
1. About Webbit Media
Webbit Media provides website design and development, hosting-related services, CRM configuration, marketing automation, communication systems, software integrations, consulting, and AI-assisted business solutions.
Certain services may be provided through third-party platforms, hosting providers, communications carriers, software providers, payment processors, artificial intelligence providers, and customer relationship management systems.
2. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to use our services.
When using our website or services on behalf of a business, nonprofit organization, or other entity, you represent that you have authority to accept these Terms on that entity’s behalf.
3. Website Use
You may use our website only for lawful business or personal purposes.
You agree not to:
- Violate any applicable law or regulation.
- Attempt to gain unauthorized access to our website, accounts, servers, databases, or systems.
- Interfere with the operation or security of our website or services.
- Introduce malware, harmful code, automated attacks, or other destructive technology.
- Scrape, copy, harvest, or collect website content or user information without authorization.
- Impersonate another person or misrepresent your identity or authority.
- Submit false, misleading, fraudulent, defamatory, or unlawful information.
- Use our services to send spam, unlawful calls, unwanted messages, or deceptive communications.
- Use our services to infringe intellectual property, privacy, publicity, or other legal rights.
- Reverse engineer, copy, resell, sublicense, or exploit our technology except as expressly authorized.
We may suspend or terminate access when we reasonably believe a user has violated these Terms or created a security, legal, reputational, or operational risk.
4. Informational Content
Website content is provided for general informational and promotional purposes. Although we try to keep information accurate and current, we do not guarantee that all website content is complete, error-free, or suitable for every situation.
Website content does not constitute legal, accounting, tax, financial, medical, cybersecurity, or other regulated professional advice.
You are responsible for obtaining appropriate professional advice before acting on information that may affect your legal rights, finances, compliance obligations, or business operations.
5. Requests for Services
Submitting a form, scheduling a consultation, requesting an estimate, or communicating with us does not automatically create a client relationship.
A formal client relationship begins only when:
- We accept the project or engagement;
- The parties agree to the applicable scope, pricing, and terms; and
- Any required agreement, proposal, deposit, or payment has been completed.
We may decline an inquiry or project at our discretion, subject to applicable law.
6. Proposals and Service Agreements
Specific projects may be governed by a separate proposal, estimate, statement of work, subscription agreement, order form, invoice, or service contract.
Those documents may include additional provisions concerning:
- Project scope
- Deliverables
- Pricing
- Deposits
- Payment schedules
- Subscription periods
- Revisions
- Client responsibilities
- Timelines
- Renewals
- Cancellation
- Ownership and licensing
- Hosting and maintenance
- Third-party services
- Confidentiality
- Support
When a separate signed agreement conflicts with these general Terms, the separate signed agreement controls for that service.
7. Client Responsibilities
Clients must provide complete, accurate, and timely information needed to perform the services.
Clients are responsible for:
- Reviewing and approving content, designs, configurations, and communications.
- Providing authorized access to domains, hosting, software, accounts, and third-party services.
- Maintaining lawful rights to all submitted text, images, logos, data, trademarks, and other materials.
- Maintaining secure passwords and protecting account credentials.
- Keeping billing and contact information current.
- Complying with laws applicable to their industry, customers, advertising, communications, privacy practices, and data.
- Reviewing automated workflows and AI-assisted outputs before relying on them.
- Obtaining required customer consent for email, SMS, telephone, recording, or AI-assisted communications.
- Honoring unsubscribe, STOP, do-not-call, privacy, and deletion requests.
- Maintaining appropriate privacy policies, terms, disclosures, and consent language.
Delays caused by missing information, approvals, access, content, payments, or third-party decisions may extend project schedules.
8. Text Messaging Terms
When you provide a mobile telephone number and opt in to receive text messages from Webbit Media, you authorize us to send SMS or MMS communications concerning your inquiry, appointments, requested services, account activity, projects, customer support, or promotions for which you have provided consent.
Program Details
- Program name: Webbit Media Messaging
- Message frequency: Message frequency varies.
- Cost: Message and data rates may apply.
- Support: Reply HELP for assistance.
- Opt-out: Reply STOP to stop receiving text messages.
After replying STOP, you may receive a final confirmation message. You will not receive additional messages from that messaging program unless you subsequently provide new consent.
Consent to receive marketing text messages is not a condition of purchasing goods or services.
Mobile information and text-message consent will not be sold, rented, or shared with third parties or affiliates for their independent marketing or promotional purposes. Information may be provided to communications carriers, CRM providers, messaging vendors, and service providers solely as necessary to deliver and support the messaging program.
HighLevel’s messaging policies provide that recognized opt-out requests such as STOP revoke SMS consent and suppress upcoming messages.
9. Email Communications
By providing your email address, you authorize us to send communications connected to:
- Your inquiry
- Appointments
- Projects
- Proposals and estimates
- Transactions
- Account notices
- Service updates
- Customer support
- Marketing communications for which you have subscribed or otherwise provided permission
Marketing emails will provide an unsubscribe method. Unsubscribing from marketing messages does not prevent us from sending transactional, security, billing, contractual, or service-related messages.
Federal CAN-SPAM guidance requires commercial email senders to use accurate sender information and subject lines and provide recipients with a functioning method to opt out.
10. Telephone, Voice, and Automated Communications
When you provide a telephone number and request or consent to contact, Webbit Media may communicate with you through:
- Manually placed calls
- Automated call routing
- Voicemail
- Prerecorded or artificial voice
- Interactive voice systems
- AI-assisted voice agents
- Appointment reminders
- Missed-call follow-up
Where required, we will obtain appropriate consent before using automated dialing, prerecorded voice, artificial voice, or automated text technologies.
The Telephone Consumer Protection Act and FCC rules restrict certain automated calls and text messages without the called party’s prior consent.
You may withdraw consent for marketing calls or messages by following the provided opt-out instructions or contacting Webbit Media directly.
11. Call Recording and Transcription
Calls may be monitored, recorded, transcribed, summarized, or analyzed for:
- Quality assurance
- Training
- Customer service
- Documentation
- Security
- Dispute resolution
- Appointment and project management
- AI-assisted response generation
We will provide notice or obtain consent when required by applicable law.
By continuing a call after receiving a recording or AI-assistance notice, you consent to the recording or processing where such consent is legally sufficient.
You should not provide highly sensitive information during a recorded call unless it is necessary and an appropriate secure process has been established.
12. Artificial Intelligence Services
Webbit Media may use artificial intelligence and automation to support:
- Website chat
- Telephone answering
- Lead qualification
- Appointment scheduling
- Email and SMS drafting
- Follow-up communications
- Conversation summaries
- Customer service
- Workflow automation
- Content preparation
- Data organization
- Business analysis
An automated assistant may respond without direct human involvement.
AI Limitations
AI-generated information may be inaccurate, incomplete, outdated, or inappropriate for a particular situation. AI systems may misunderstand a question, fail to identify context, or generate incorrect information.
You agree that:
- AI responses should be reviewed before being relied upon.
- AI responses do not constitute professional advice.
- Important decisions should be confirmed with a qualified human.
- AI systems must not be used for emergencies.
- You will not submit confidential or sensitive information unless authorized and reasonably necessary.
- You remain responsible for your use of AI-generated content and recommendations.
Webbit Media does not guarantee that AI systems will provide uninterrupted, accurate, or error-free results.
13. Emergency and Regulated Matters
Webbit Media’s websites, messaging systems, chat tools, and AI services are not emergency services.
Do not use them to report:
- Medical emergencies
- Threats to personal safety
- Fires
- Crimes in progress
- Hazardous conditions
- Other urgent emergencies
Call 911 or the appropriate local emergency service.
Our AI and communications tools are also not substitutes for licensed legal, medical, financial, insurance, engineering, or other regulated professional services.
14. Appointments and Scheduling
Appointments scheduled through our website or communications systems are subject to availability and confirmation.
We may send reminders by email, text message, or telephone. You are responsible for ensuring the contact information provided is correct.
Scheduling an appointment does not guarantee that we will accept a project or provide a specific service.
We may reschedule or cancel appointments due to availability, emergencies, technical problems, or other reasonable circumstances.
15. Fees and Payment
Prices may be provided through proposals, estimates, invoices, service agreements, or subscription plans.
Unless otherwise stated:
- Payments are due according to the applicable invoice or agreement.
- Deposits may be nonrefundable once work begins.
- Recurring services may be billed in advance.
- Third-party expenses may be billed separately.
- Work may be paused for overdue balances.
- Access to hosted or subscription services may be suspended for nonpayment.
- Client delays do not automatically extend payment due dates.
You are responsible for applicable taxes, fees, processing charges, and third-party costs unless otherwise stated.
16. Recurring Services and Renewals
Hosting, maintenance, CRM, software, communications, AI, support, or subscription services may renew automatically when disclosed in the applicable proposal, invoice, checkout page, or service agreement.
Recurring charges may continue until cancellation is received in accordance with the applicable service agreement.
Cancellation does not automatically result in a refund for previously billed periods, completed work, committed third-party expenses, registered domains, software licenses, messaging charges, or other nonrecoverable costs.
17. Third-Party Products and Services
Our services may rely on third parties such as:
- Web-hosting companies
- Domain registrars
- Email providers
- Telephone and messaging carriers
- CRM platforms
- Payment processors
- Advertising platforms
- Analytics providers
- Artificial intelligence providers
- Software plugins
- Social networks
- Cloud-storage services
Third-party services are governed by their own terms, privacy policies, pricing, availability, and technical limitations.
Webbit Media does not control and is not responsible for:
- Third-party outages
- Pricing changes
- Policy changes
- Account suspensions
- Data loss caused by third parties
- Carrier filtering
- Search-engine rankings
- Social-platform decisions
- Software incompatibilities
- API changes
- Vendor security incidents
- Discontinued features or services
We may recommend or configure a third-party service, but this does not constitute a guarantee of its continued availability or performance.
18. Messaging and Carrier Limitations
Email, telephone, SMS, MMS, and automated communications may be delayed, filtered, blocked, misrouted, or undelivered because of:
- Carrier policies
- Spam filtering
- Recipient settings
- Invalid contact information
- Network outages
- Registration or verification requirements
- High opt-out or complaint rates
- Content restrictions
- Third-party platform policies
We do not guarantee delivery of every email, call, voicemail, or text message.
Clients using our communication services are responsible for maintaining valid consent records and following applicable carrier and platform requirements. HighLevel currently supports separate consent collection for marketing and non-marketing communications and recommends including sender identification and opt-out instructions in messaging programs.
19. Intellectual Property
Unless otherwise stated, the Webbit Media website and its original content, layout, designs, text, graphics, logos, software, documentation, workflows, processes, and branding are owned by or licensed to Webbit Media and are protected by intellectual-property laws.
You may not reproduce, modify, publish, distribute, display, sell, sublicense, or create derivative works from our materials without written permission.
“Webbit Media,” “GrowthCommander AI,” and associated names, logos, slogans, and branding may not be used without authorization.
20. Client Materials
You retain ownership of materials you provide to us, subject to any rights granted in a separate service agreement.
You grant Webbit Media a limited license to access, copy, modify, store, display, transmit, and use those materials as reasonably necessary to provide the requested services.
You represent that you own or have permission to use all materials provided to us and that their use will not violate another party’s copyright, trademark, privacy, publicity, confidentiality, or other rights.
21. Portfolio Use
Unless prohibited by a separate written agreement, Webbit Media may identify completed public-facing work in its portfolio, proposals, case studies, and promotional materials.
We will not intentionally disclose confidential business information through portfolio use.
A client may request in writing that a project not be publicly displayed. Any such restriction must be agreed upon before or during the engagement.
22. Confidentiality
Each party may receive nonpublic information from the other while evaluating or performing services.
The receiving party will use reasonable care to protect confidential information and will use it only for the applicable business relationship.
Confidential information does not include information that:
- Was already lawfully known;
- Becomes public without a breach;
- Is independently developed;
- Is lawfully received from another source; or
- Must be disclosed by law or legal process.
Additional confidentiality terms may be included in a separate service agreement.
23. Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms.
By using our website or services, you acknowledge that information may be processed through third-party hosting, CRM, email, messaging, telephone, AI, scheduling, analytics, and payment providers.
24. Security
We use reasonable measures intended to protect our website and systems. However, no internet service, website, communications platform, or database is completely secure.
You are responsible for:
- Protecting passwords and login credentials;
- Using multifactor authentication when available;
- Restricting account access to authorized individuals;
- Maintaining secure devices and networks;
- Promptly reporting suspected unauthorized access; and
- Keeping independent backups when appropriate.
25. No Guarantee of Business Results
Webbit Media may provide websites, marketing systems, CRM technology, automation, AI, messaging, integrations, or consulting intended to improve business operations and opportunities.
We do not guarantee:
- Leads
- Sales
- Revenue
- Search-engine rankings
- Advertising results
- Appointment volume
- Customer conversion
- Email or SMS delivery
- Regulatory approval
- Platform approval
- Uninterrupted service
- Specific financial outcomes
Results depend on many factors outside our control, including market conditions, client participation, pricing, reputation, competition, advertising budgets, consent quality, customer demand, and third-party platforms.
26. Disclaimer of Warranties
To the fullest extent permitted by law, the website and general online services are provided on an “as is” and “as available” basis.
Webbit Media disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and uninterrupted operation.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
27. Limitation of Liability
To the fullest extent permitted by law, Webbit Media will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost opportunities, lost data, reputational harm, or business interruption arising from the website or services.
Except for liability that cannot legally be limited, Webbit Media’s total liability concerning a particular paid service will not exceed the amount paid directly to Webbit Media for that service during the six months preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law or where a separate written agreement provides otherwise.
28. Indemnification
You agree to defend, indemnify, and hold harmless Webbit Media, its owners, employees, contractors, and service providers from claims, damages, liabilities, penalties, costs, and reasonable attorneys’ fees arising from:
- Your unlawful use of the website or services;
- Materials or data you provide;
- Your violation of these Terms;
- Your communications with customers or prospects;
- Your failure to obtain required consent;
- Your violation of privacy, messaging, advertising, intellectual-property, or consumer-protection laws; or
- Your misuse of AI, automation, CRM, email, telephone, or messaging systems.
This section applies only to the extent permitted by applicable law.
29. Suspension and Termination
We may suspend or terminate website or service access when:
- Fees remain unpaid;
- These Terms are violated;
- We suspect fraud, abuse, unauthorized access, or unlawful activity;
- A third-party provider suspends or terminates the underlying service;
- Continued service creates a legal, security, technical, or reputational risk; or
- A service agreement permits termination.
Termination does not eliminate payment obligations or rights that accrued before termination.
Sections concerning ownership, confidentiality, payment, disclaimers, limitations of liability, indemnification, and dispute resolution survive termination where applicable.
30. Copyright Complaints
A person who believes material on our website infringes their copyright may contact us with:
- Identification of the copyrighted work;
- Identification and location of the allegedly infringing material;
- Contact information;
- A statement of good-faith belief;
- A statement that the information provided is accurate; and
- A physical or electronic signature.
We may remove or restrict access to material while reviewing a complaint.
31. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.
Any legal action that is not subject to a different written agreement must be brought in an appropriate state or federal court located in Connecticut, and the parties consent to that jurisdiction and venue.
32. Informal Dispute Resolution
Before filing a legal action, you agree to provide written notice describing the dispute and allow Webbit Media at least 30 days to attempt to resolve it informally.
This requirement does not prevent either party from seeking emergency injunctive relief or taking action necessary to preserve a legal claim.
33. Changes to These Terms
We may update these Terms to reflect changes in our services, technology, business practices, or legal obligations.
Updated Terms will be posted with a revised “Last Updated” date. Your continued use of the website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
Material changes affecting an existing paid service may also be governed by the applicable service agreement.
34. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary, and the remaining provisions will remain in effect.
35. No Waiver
Failure to enforce a provision of these Terms does not waive our right to enforce it later.
36. Entire Agreement
These Terms, our Privacy Policy, and any applicable proposal, invoice, statement of work, order form, or signed service agreement constitute the agreement governing your use of the applicable website or service.
